Acceptable Use And Online Policies

NU-Z.Net's Acceptable Use Policy ("AUP") is intended to enhance the use of the Internet by preventing unacceptable use of any services we (NU-Z.Net) provide. All users are bound by this policy.

 

To ensure equal Internet access for all NU-Z.NET subscribers, our network operations center maintains utilization statistics to establish an equitable balance in Internet access for all NU-Z.NET customers regardless of their frequency of use or volume of traffic. To ensure this equity, customers may experience some temporary throughput limitations. NU-Z.NET Internet access is not guaranteed. To ensure that all NU-Z subscribers have fair and equal access to the service, NU-Z has enacted procedures to prevent abusive consumption of system resources. When a subscriber exhibits patterns of system usage which adversely affect overall system resources, the network operations center may invoke any of the penalties listed in this AUP it deems necessary to correct the problem.

Violations of this AUP may result in the suspension or termination of account or services of the end user.

VIOLATIONS OF ACCEPTABLE USE POLICY

 

The following constitute violations of this AUP:

A.      Illegal use. Using NU-Z.Net's services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law.

B.      Harm to minors. Using our services to harm, or attempt to harm, minors in any way.

C.      Threats. Using our services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.

D.     Harassment. Using our services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.

E.      Fraudulent activity. Using our services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."

F.      Forgery or impersonation. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person or business entity by using forged headers or other identifying information is prohibited.

G.     Unsolicited commercial email/Unsolicited bulk email. Using our services to transmit any unsolicited commercial e-mail or unsolicited bulk e-mail is prohibited. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that e-mail is commercial in nature are also prohibited.

H.      Unauthorized access. Using our services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of NU-Z.Net's Internet Services or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data.

I.       Copyright or trademark infringement. Using our services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

J.       Collection of personal data. Using our services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

K.      Reselling our services. Reselling our services without NU-Z.Net's written authorization.

L.      Network disruptions. Using our services for any activity which adversely affects the ability of other people or systems to use NU-Z.Net's Internet Services or the Internet. This includes but is not restricted to: "denial of service" (DoS) attacks against another network host or individual user, any techniques designed to cause damage to or deny access by legitimate users of computers or network components connected to the Internet, hosting web servers or engaging in file-sharing activities that cause interference with or disruption of other network users, network services or network equipment.

 

PENALTIES *

 

NU-Z.Net may take any one or more of the following actions in response to complaints and/or violations of the AUP:

A.      issue warnings: written or verbal

B.      suspend account

C.      terminate account

D.     bill for administrative and investigative costs and/or reactivation charges

E.      bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

* There will be no refund when an account is terminated or suspended for AUP violations.

REVISIONS TO THIS ACCEPTABLE USE POLICY

NU-Z.Net reserves the right to revise, amend, or modify this AUP, our Internet Service Agreement and our other policies and agreements at any time and in any manner. Policy changes take effect upon posting of revision to AUP on NU-Z.Net's Web site: www.nu-z.net.

Service Agreement

1. I understand that I may cancel my account at any time effective at the end of that billing cycle.

2. I understand that NU-Z.Net may change its prices on occasion, and that I will be given a 15 day written or electronic mail notice beforehand.

3. I understand that multiple simultaneous logins using the same password are not allowed and if this occurs I will be billed for multiple accounts. If after notice of such occurrences, continued simultaneous logins whereby customer does not agree to pay for separate accounts, will result in discontinuance of service by NU-Z.Net.

4. I understand that unlimited-access non-dedicated-line accounts are not limited in their hours, but are not intended to be full time. NU-Z makes no restriction on usage provided that such usage does not adversely affect NU-Z.Net’s customers.

5. I understand that NU-Z.Net cannot guarantee that I connect at my modem’s maximum speed due to the condition (noise, signal loss, or distance) of phone lines between myself and NU-Z.Net’s network.

6. I agree to keep my password as private and confidential information.

7. I understand that the information available through NU-Z.Net or interconnecting networks may not be accurate, or may be intended for adult audiences.

8. I understand that the most Internet communications are not secure, and may be subject to interception or loss.

9. I understand that the use of my NU-Z.Net account, and any data or information accessed or transmitted using that account will be completely at my own risk.

10. I agree that NU-Z.Net shall have no liability for the services, data or information made available to me, including any liability for any consequential, indirect, special or incidental damages regardless of the success or effectiveness of other remedies.

11. I understand that NU-Z.Net reserves the right to terminate my account at any time, for any reason, including, but not limited to, my failure to abide by the terms of this agreement or my failure to pay any charges when due.
